Terms and Conditions Governing BOC UnionPay Cards Cash Rebate Promotion (1 January 2017 to 31 March 2017) 

1. The BOC UnionPay Cards Cash Rebate Promotion (the “Promotion”) is valid for dining, major department store and online purchase, it is also valid for all spend in Mainland China charged and posted from 1 January 2017 to 31 March 2017 to the BOC Dual Currency Diamond Card, BOC Travel Card and BOC Dual Currency mBusiness Card (the “Card) issued by Bank of China Limited, Singapore Branch (“BOC”). 

2. Both principal and supplementary Cardmembers are eligible for this Promotion. The Qualifying Spend of principal Cardmembers and that of their supplementary Cardmembers shall not be aggregated or combined in any way to satisfy the Minimum Spend Requirement (as defined below) or for the purposes of award of the Cash Rebate (as defined below). 

3. Qualifying Cardmembers will receive a cash rebate amounting to 10% of the total qualifying dining, major department store spend and online purchase. Qualifying Cardmembers will receive a cash rebate amounting to 5% of the total qualifying spend in Mainland China. The total cash rebate is subject to the maximum amount provided in Clause 4 below that is charged and posted to the Card during per month (“Cash Rebate”). 

For the purposes of the Promotion, a “Major Department Store” means any of the following major department stores in Singapore which accepts UnionPay Cards: BHG, Isetan, John Little, Marks & Spencer, Metro, OG, Robinsons, Takashimaya and TANGS. Online transactions refer to websites that accept UnionPay cards – Agoda, Amazon, Asiatravel, Centara Resorts , Citytours, Concorde Hotel, Giant Online, Jing Dong,  ezbuy (formerly 65Daigou), Mount Faber, Reebonz, Resorts World, Sistic , TREOO and others. 

The following transactions are not eligible for Cash Rebate under the Promotion:

(a) Transactions with merchants which are not listed in the definition of “Major Department Store” above;

(b) Transactions whose merchant codes which BOC determines are not appropriate merchant codes for the relevant merchant’s business;

(c) Fraudulent transactions; and

(d)Unauthorised transactions.                     

4. During per month, Cardmembers must accumulate Qualifying Spend amounting to at least S$300 monthly charged to the account of a qualifying Card (the “Minimum Spend Requirement”) before any Cash Rebate will be awarded to such Cardmembers. The maximum amount of Cash Rebate that a Cardmember may be awarded under the Promotion is capped at S$80 per month.

Total – Spent $1,200 and earn S$80 cash rebate

Cash  Rebate awarded is capped at $80.

5. Any Cash Rebate awarded shall not be transferable and is strictly not exchangeable for cash, credit, cashier’s orders, reward points or other things or benefits, whether in whole or in part.

6. The Card accounts should not be suspended, cancelled or terminated for any reason, in good standing and conducted in a proper and satisfactory manneras determined by BOC in its sole and absolute discretion will be eligible for the Cash Rebate under the Promotion. Any Cash Rebate awarded shall be credited to the relevant Card account within one (1) month after statement date. Any Cash Rebate awarded may be cancelled or recovered in whole or in part by BOC in the event that the relevant transactions are cancelled or reversed or if BOC has reason to believe that the relevant transactions are unauthorised or that fraud is involved. 

8. BOC shall not be liable in any way to any Cardmember or any other person for any loss, damage or expenses arising out of or in connection with the Promotion, including without limitation, any loss, damage or expense incurred or sustained by reason of any late notification or non-notification by any party. BOC shall not be responsible for any late submission of transaction details by any major Department Store. 

9. BOC reserves the right to substitute or replace the Cash Rebate with another gift of approximately the same value (to be determined by BOC in its sole and absolute discretion) at any time without giving any prior notice or reason. 

10. BOC shall not be responsible in any manner whatsoever for any delay or failure howsoever caused in the sending or receiving of any SMS in connection with the Promotion. Cardmembers will be solely responsible for all fees and charges imposed by their mobile phone service provider for the receiving of any SMS in connection with the Promotion.  

11.  By participating in the Promotion, a Cardmember irrevocably permits and authorises BOC and its agents and vendors(including but not limited to any authorised party involved in organising, promoting and conducting the Promotion) to collect, store, use, process and disclose his/her personal data and information, in whole or in part whether in Singapore or outside Singapore, to any person for the purpose of the Promotion, and confirms that he/she has read and agrees to be bound by the terms of BOC’s Personal Data Protection Policy, as may be amended, supplemented and/or substituted by BOC from time to time, an up-to-date copy of which may be found on http://www.bankofchina.com/sg/aboutus/. 

12. BOC shall be entitled to amend, vary, modify, supplement or cancel any of the terms and conditions of the Promotion (the “Terms and Conditions”) or change or withdraw the Promotion, or to terminate your participation in the Promotion, at any time without giving any reason or prior notice. In such event, you shall not hold BOC responsible notwithstanding that you may have fulfilled one or more criteria of the Promotion hereunder or that you are eligible to receive or have received the Cash Rebate. In the event of any dispute, BOC’s decision on all matters relating to the Promotion shall be final and BOC will not enter into any correspondence in respect of any dispute or decision made. By participating in the Promotion, a Cardmember shall be deemed to have read, understood and accepted the Terms and Conditions. The Terms and Conditions are additional to the terms of the BOC Cardmember Agreement, which shall continue to apply. 

13. BOC is not an agent of any of the Online Merchants, Dining Merchants or major Department Stores, or any of their affiliates or business partners and makes no representation as to the quality, finesse of use or merchantability of goods or services provided by any Online Merchant, Dining Merchants or major Department Store BOC assumes no responsibility whatsoever in respect of the said goods and services rendered. Any dispute which a Cardmember may have in relation to the goods or services provided by any Online Merchant, Dining Merchants or major Department Store shall be resolved directly between the Cardmember and such Online Merchant, Dining Merchants or major Department Store without BOC’s involvement. 

14. The Promotion is not valid with any other promotion and may not be used in combination or in conjunction with any other promotion. 

15. In the event of any inconsistency between the English version of the Terms and Conditions and any information contained in (i) brochures, marketing and promotional materials relating to the Promotion; or (ii) the Chinese version of the Terms and Conditions; or (iii) the Chinese version of the brochures, marketing and promotional materials relating to the Promotion, the English version of the Terms and Conditions shall prevail. In the event that there is any inconsistency between any term hereunder and any term of the BOC Cardmember Agreement, the former shall prevail. 

16.  These Terms and Conditions are governed by and shall be construed in accordance with the laws of Singapore and by participating in the Promotion, the Cardmember irrevocably submits to the non-exclusive jurisdiction of the Singapore courts.
